[New Treaty] Micras Treaty for International Treatment of Sentience

Delegates,

This has not been done for awhile, but the suggestion was brought up. The original intent of the MTO was to be a talkshop for multilateral treaties. The MTO opinions have been a way to generate activity and discussion and gauge interest in "going further."

Treaties written by the General Assembly only require a simply majority to be added to the "treaty buffet." MTO membership does not imply support or interest in any of these ancillary treaties. I ask delegates to keep this in mind when engaging in debate.
Micras Treaty for International Treatment of Sentience

[preamble]

1. Equal protection: Signatories pledge to ensure equal protection of their domestic laws to all sentient residents/citizens of their nations.
2. Reciprocity: Signatories pledge to recognize the non-human sentient beings of other signatory nations as if they were human.
3. Definition: Sentient beings are defined as being biological life that has developed a comparable level of intelligence and self-awareness to that of a human on Micras. Includes non-humans native to Micras (elves) and includes aliens (Çerid, Safir).
4. Exclusions: Supernatural, artificial, and/or deceased sentient beings shall not be included in the scope of this treaty, even if a signatory nation extends equal protection and rights to those categories.
5. Disagreements shall be settled by bilateral negotiations, failing that then the Common Court of the MTO
6. Call to action: Signatories shall try to not allow non-human residents or citizens to fall into a disadvantaged category, even if equal protection is guaranteed.
7. Self-policing: A signatory of this treaty may inform the Sec-Gen if another signatory is not fulfilling the terms by presenting their evidence in an open letter to the Sec-Gen. At that point the other signatories will decide among themselves how to enforce this treaty (sanctions, travel ban, war, etc).
8. Activation and provisions: Shall come into force when 3 nations have signed and ratified. Can be amended by a majority of signatories. A signatory can withdraw 1 year after public notification to the Sec-Gen

The People's Republic of Graecia would not sign such a treaty, because we do not recognise non-human species as sapient, rather as weapons of imperialist nations to subdue others. And, none of them could enter our nation, because our homeland (the Graecian Isle) was never home to such species.
Still, we would remain silent and not block other nations from doing so; we just want to remind them that they should reconsider their policies.

Chryse would be interested in participating in such a treaty. We regard the sanctity of life to the highest degree.
The Hurmu ambassador speaks:
I agree with my hon. colleague from Chryse. This is part of the Hanwen u-Brida of our people. We will be happy to participate in formulating such a treaty.
The Zeed ambassador speaks:
Under the principles of human superiority, the government of Zeed regrets that it will not be able to participate in this treaty. It is of utmost importance that Micras remains a planet by humans for humans. Humanism should be the guiding ideology of all of Micras. To regard Bassarids, Vanics and safir to be equal to humans is an affront to human dignity and threatens to upset the stability of our reformed world.

The Riqi Elluenuuerssuarion and the Unified Governorates of Benacia jointly condemn this treaty and the proposed extension of a system of rights to non-human entities in the most absolute and strongest terms. We do however wish to correct the honourable representative of Zeed. We have dissected enough Froyalaner cadavers over the years to confirm their humanity. The more outlandish claims made regarding their physiology and regenerative abilities can be safely discounted.

Calbion also will not join this treaty. Although we are strongly against animal abuse and cruelty towards other species, human rights belong to humans. We as humans are the creation of Cato, endowed with the experience of Tarynn, the life of Glanya, the dexterity of Cyll, the wisdom of Ddytha, the bravery of Llyd, the depth of Môrlwydd and the resonance with the earth of Craitmyn. To act as if animals hold those same sacred gifts is nothing but blasphemy.

The Natopian delegation:
Natopia has a rich history of diversity and inclusion. We see nothing in this Treaty to object to. If a sentient life form can learn a human language, converse with us, assimilate into human cultures, and act in such a way that their "non-humanness" is only noticed because of physical differences then there is no reason why human-like non-humans should not be afforded the same rights. Anything less is state-sponsored racism and xenophobia.

We are pleased that exemptions to "supernatural" beings is included, as there is high evidence that the Vanic-infestation is demonic, or supernatural (as they themselves claim in their own heresies).
Drak-Modani delegation:
We remember a time when we were ruled by the undead, and then demons, and those were turbulent times. Even though those classes are exempted it would be a slippery slope. We cannot give carte blanche to subhuman creatures. We are prepared to evaluate non-humans on a case by case basis, to grant them the rights of citizen if they meet certain ethical and moral tests. However, we will not be party to this treaty.

The Alduro-Wechua Federation and the Kingdom of Ransenar also join Constancia in their opinion on this matter.

Alduria-Wechua tolerates the existence of the Cerid, however, and have special laws to ensure that. But we shall not extend this to the others.

The UGB proposes the treaty text be replaced in its entirety with the following:
Treaty for the Supremacy of Humanity on Micras

[preamble]

1. Signatories shall undertake to ensure the primacy of humanity as the determining qualification in their domestic laws for citizenship and the exercise of rights associated with the electoral franchise and representative government.
2. Signatories pledge to exclude any non-human sentient being from the public spaces of their countries except and unless the aforementioned has a guarantor who is a human citizen of the signatory country.
a. Travel between a signatory nation and any other nation by a non-human sentient subject of that signatory nation shall be prohibited unless authorised by the non-human sentient's guarantor.
3. Definition: A non-human sentient is defined as being a biological entity that has developed a comparable level of intelligence and self-awareness to that of a human on Micras. Includes non-humans native to Micras and includes aliens of extra-terrestrial origin.
a. Artificial intelligences, defined as mechanical or computer systems capable of performing tasks normally requiring human intelligence, shall remain classed as property to be regulated by domestic intellectual property, research and patent laws.
4. Signatories shall undertake to subject non-human sentients to a rules-based system of law with the requirement that this system of law shall differ from the law governing human citizens and residents, shall not afford non-human sentients greater dignities and protections than afforded to humans, and shall be determined and administered solely by human authorities.
5. Signatories undertake to prevent and suppress all forms of self-government by non-human sentients within their respective jurisdictions.
6. Signatories shall eradicate all prohibited non-human sentient life within their respective jurisdictions.
7. Prohibited forms of non-human sentient life shall include any which fall into the following categories:
a. Insectoid;
b. Psionic (capable of telekinetic or telepathic actions);
c. Revenant (the re-animated form of a deceased entity, whether it be human or a non-human sentient being);
d. Hateful or Harmful to Humanity (including creatures that generate wholly natural and instinctive feelings of abhorrence or which prey on humans for sustenance, e.g. vampires).
8. Signatories shall enact laws to prevent hybridisation between human and non-human sentient beings, including prohibitions on research into the same.
9. Signatories shall undertake every practicable effort to ensure the termination of illegal hybrids, where they have been discovered to have occurred, before they come to term.
10. Where it has been impossible to prevent the birth of a hybrid it shall, upon its discovery, be treated as a non-human sentient unless it belongs to a prohibited category where in which case it shall be terminated.
11. Signatories shall undertake to ensure that domestic employment laws will guarantee that no human citizen shall be disadvantaged or denied work by the employment of a non-human sentient.
12. Disagreements shall be settled by bilateral negotiations, failing that then the Common Court of the MTO.
13. A signatory of this treaty may inform the Secretary-General of the MTO if another signatory is not fulfilling the terms by presenting their evidence in an open letter to the Secretary-General of the MTO. At that point the other signatories will decide among themselves how to the signatory in question shall be returned to compliance.
14. This treaty shall come into force when three (3) nations have signed and ratified. Can be amended by a majority of signatories. A signatory can withdraw one (1) Norton year after public notification to the Secretary-General of the MTO.

These amendments fundamentally alter the Treaty beyond the original intent. I will propose this as a separate discussion with the UGB delegation as the sponsor.

Keeping in mind that if your nation does not want to extend equal protections to other sentient beings, the other treaty is now available for discussion. I ask that this discussion be reserved for constructive criticism and debate for this treaty and its stated goals.

If there is no further debate on this treaty, we will begin voting on it in a few days.

Hurmu takes objection to the notion that Elves are a separate species from humans. We regard them as an ethnic group, or at the extent a human subspecies. Given that the Elwynnese authorities have shown repeated fertile intermixture, it means that the Elfinshi cannot be a separate species. Otherwise, we are happy to support this treaty.

Perhaps the best thing would to simply remove the examples. The treaty works without them.
